(San Diego County Superior Court Case No. 37-2010-00072138). This settlement occurred after the San Diego County Superior Court decided that it would reconsider its April 15, 2011 order forcing Plaintiff Daniel Wiltse to arbitrate his claims against the defendants, rather than litigating them in court. After the date for the reconsideration motion was scheduled, defendants Road Motors and Credit Acceptance Corporation reached a settlement with Plaintiff Daniel Wiltse and his San Diego, CA lemon law lawyer.

One of the defendants, Road Motors, is a popular San Diego County used car dealership. The other defendant, Credit Acceptance Corporation, is a well known lender that finances vehicle purchase loans.

THE LAWSUIT'S COMPLAINT ALLEGED THAT ROAD MOTORS FALSIFIED DOWN PAYMENT AMOUNTS & VIOLATED THE CALIFORNIA LEMON LAW

The complaint in the Road Motors lawsuit alleged that Road Motors sold Plaintiff Daniel Wiltse (a San Diego, CA consumer) a used Mercedes-Benz that had been in a prior accident and which turned out to be unsafe and inoperable. Mr. Wiltse's lemon law attorney asserted that the vehicle's alleged defects amounted to a breach of the implied warranty of merchantability imposed by California's lemon law. Lastly, the complaint also alleged that Road Motors falsified the down payment amounts in Mr. Wiltse's vehicle purchase contract in order to get him approved for a loan for which he otherwise would not have qualified.

Please note: Road Motors and Credit Acceptance Corporation denied all liability during the lawsuit, and claimed that they committed no wrongdoing. Further, under the terms of the settlement agreement they admitted no liability or illegal conduct.
