• Senior Healthcare Consultants v. Tammy Hoschar, Cause No. DC-10-08604; In the 116th Judicial District Court, Dallas County, Texas. In 2007, Senior Healthcare hired Hoschar as a health insurance sales representative. Hoschar left the company in June 2010 and began working for a competitor. Senior Healthcare Consultants sued Hoschar, alleging breach of contract and defamation. Ramez Shamieh represented Defendant Hoschar and filed a counterclaim for breach of contract alleging that she had not been paid commissions she had earned between January 2010 and June 2010. Ramez Shamieh argued that Senior Healthcare's failure to pay Hoschar's commissions constituted a breach of her employment agreement and excused her from performance under the contract. Senior Health Care sought $90,000 in damages on the breach-of-contract claim, $10,000 on the defamation claim, and also attorney's fees. Hoschar sought damages and attorney's fees. Judge Parker dismissed Senior Healthcare's defamation claim on the grounds that it did not have standing under Texas law. Further, Judge Parker held that Senior Healthcare violated the employment agreement and awarded Hoschar her commissions and attorney's fees.
