New Cars, Inc. Sued by Southern California Consumer Law Attorney

New Cars, Inc. is the latest Southern California used car dealership to be named in a lawsuit filed by prolific California lemon law lawyer Michael R. Vachon, Esq.

Prominent consumer law lawyer Michael R. Vachon, Esq. has announced the filing of another lawsuit against a Southern California used car dealership. Vachon, who in 2009 founded the consumer protection law firm that bears his name, has filed over 100 lawsuits against California car dealership alleging fraud, violation of the California lemon law, breach of warranty, failure to disclose known defects, and willful non-compliance with State automobile financing laws. He claims that fraud and trickery have become commonplace in the used car industry, as evidenced by the sheer number of successful lawsuits in which he has participated as a consumer attorney.

LAWSUITS AGAINST NEW CARS, INC. INCLUDES CLAIMS UNDER CALIFORNIA'S LEMON LAW

The defendant this time is New Cars, Inc., a popular San Diego, California auto retailer, who in late 2011 sold a used 2009 Ford Fusion to San Diego, California consumer Derek Gilbert. Mr. Gilbert, through his lemon law attorney, alleges in the lawsuit that the Ford Fusion's poor mechanical condition, as well as its history, violated the "implied warranty of merchantability." The implied warranty of merchantability is a very basic warranty imposed by California's lemon law statute that essentially guarantees that the vehicle will provide safe transportation and conforms to whatever promises the selling dealer made to the buyer.

Mr. Gilbert's attorney has also alleged that New Cars, Inc. knew that the Ford Fusion had previously been registered as a rental automobile, and had also been damaged in a collision. Based on these allegations the lawsuit asserts causes of action for fraud and violation of California's consumer protection statutes.

The lawsuit is titled Gilbert v. New Cars, Inc., et al (Case No. 37-2012-00097159). The Court hearing the lawsuit has not yet ruled on whether Mr. Gilbert's allegations are true, or on whether New Cars, Inc. violated the law.
