Lemon Law Attorney Sues Infiniti of Mission Viejo for Alleged Lease Financing Violations
Online, September 3, 2013 (Newswire.com) - Infiniti of Mission Viejo, the popular Orange County, California new car dealership has been named as the defendant in a lawsuit filed by the prolific California consumer law advocates the Vachon Law Firm. The lawsuit was filed on July 8, 2013 in California's Orange County Superior Court, and alleges that the dealership misrepresented and failed to properly disclose the amount of "negative equity" in a consumer's lease contract. It also alleges that the Plaintiff, a Southern California consumer, is not the only victim of Infiniti of Mission Viejo's asserted illegal conduct. The lawsuit is titled Boinus-Reehorst v. Infiniti of Mission Viejo, et al. (Case No. 30-2013-00660120).
THE LAWSUIT'S ALLEGATIONS
In the Boinus-Reehorst v. Infiniti of Mission Viejo lawsuit, the Plaintiff alleges that she paid a visit to Infiniti of Mission Viejo's dealership lot in mid-2013 while shopping for new automobile. The Plaintiff goes on to allege that at the time she was already leasing another Infiniti brand automobile, and was looking to trade it in and lease a new Infiniti G37.
The Complaint asserts that when Plaintiff expressed an interest in leasing a new Infiniti G37, Infiniti of Mission Viejo contacted the lender financing the current lease, and discovered that, based on the lease payoff amount and the vehicle's fair market value, Plaintiff had over $5,300 in "negative equity" in the trade-in vehicle.
Negative equity is present whenever a consumer owes more towards a vehicle's loan or lease than the vehicle is worth. As a result, when a consumer trades in a car in which he or she has negative equity this effectively increases the amount that he or she will have to finance towards the new vehicle's loan or lease.
In the lawsuit, the Plaintiff is asserting that Infiniti of Mission Viejo illegally misrepresented and failed to properly disclose the amount of negative equity in her trade-in vehicle. She alleges in the Complaint that the dealership tricked her into believing that the negative equity was less than it actually was. Specifically, the lawsuit asserts that Infiniti of Mission Viejo failed to properly disclose the amount of negative equity in order to trick the Plaintiff into entering into a lease that she otherwise would have refused to sign.
Infiniti of Mission Viejo's attorney has denied that the dealership's conduct was illegal and has announced the dealership's intent to vigorously defend the lawsuit.
The Orange County Superior Court has not yet made any ruling on whether or not Infiniti of Mission Viejo violated any laws.
