Hayward Toyota Agrees to Settlement With California Lemon Law Attorney in Lawsuit Alleging Violation of Lemon Law

San Francisco-Bay Area car dealership Hayward Toyota reaches a settlement with prominent California lemon law attorney in lawsuit alleging violations of the California lemon law statute and falsification of contract down payment amounts.

California lemon law attorney Michael R. Vachon, Esq. has announced a settlement with the defendant Auto Mission, Ltd. in a lawsuit that alleged violation of California's lemon law statute and the deliberate falsification of a vehicle purchase contract. Auto Mission, Ltd. is a well known San Francisco-Bay Area car dealer that does business in Hayward, California under the name "Hayward Toyota." The plaintiff, Karen Gordon-Brown, is an Oakland, California resident who was represented in this case by respected California lemon law lawyer Michael R. Vachon, Esq. The lawsuit was originally filed on December 8, 2011 (Gordon-Brown v. Auto Mission, Ltd., et al., Alameda County Superior Court Case No. HG11607769).

LAWSUIT'S ALLEGATIONS AGAINST HAYWARD TOYOTA

The Hayward Toyota lawsuit arose out of Ms. Gordon-Brown's purchase of a Volkswagen Jetta from Hayward Toyota on October 23, 2011. Shortly thereafter, Ms. Gordon-Brown's lemon law attorney Michael R. Vachon, Esq. filed a complaint in the Alameda County Superior Court alleging, in part, that Hayward Toyota had violated California's Automobile Sales Finance Act and lemon law statute. More specifically, lemon law attorney Vachon's complaint alleged that Hayward Toyota had deliberately falsified the down payment amounts in Ms. Gordon-Brown's purchase contract in order to get her an auto finance loan for which she otherwise would not have qualified. The complaint filed by Ms. Gordon-Brown's lemon law lawyer also alleged that Hayward Toyota breach the implied warranty of merchantability imposed by California's lemon law as a result of the fact that the Volkswagen Jetta became inoperable shortly after Ms. Gordon-Brown purchased it.

SETTLEMENT NEGOTIATED BY HAYWARD TOYOTA AND CALIFORNIA LEMON LAW LAWYER

Ms. Gordon-Brown's lemon law lawyer has announced that under the settlement, Toyota of Hayward has agreed to repurchase the Volkswagen Jetta and give back all of the money that Ms. Gordon-Brown paid for it. Ms. Gordon-Brown will also receive an unspecified additional payment, and Hayward Toyota has agreed to pay the fees and costs incurred by her California lemon law lawyer.

Note: Throughout this lawsuit Hayward Toyota denied all of the California lemon law and other allegations in the complaint filed by Ms. Gordon-Brown's lemon law attorney. Further, in the settlement Hayward Toyota did not admit that it violated any applicable laws or otherwise committed illegal conduct.
