According to the journal, the two settlements that were listed in "Big Money Wins" for the firm includes an $18 million settlement reached in Gardener v. City of New York and a $12 million settlement in the Pelham Bay Landfill lawsuit.

Facts of the Gardener Case

According to court documents, in Gardener v. City of New York, the firm represented plaintiff Gardener in a suit against the City of New York, alleging that the deadly crossover collision on July 9, 2006 on the Bronx River Parkway, which resulted in 6 deaths and left the plaintiff with severe brain trauma, was the result of a barrier that was of the wrong size and shape.

"We were able to prove that the City of New York was at fault for failing to replace the improper barrier with a proper, taller barrier that has been proven to prevent such accidents," commented lead attorney and partner Jeff S. Korek.

Gersowitz, Libo & Korek, P.C. was ultimately able to secure an $18 million settlement for the sole survivor of the accident.

Facts of the Pelham Bay Landfill Case

Court documents reveal that the Pelham Bay Landfill Case was filed on behalf of neighboring residents to the Pelham Bay Landfill, alleging that the plaintiffs' childhood leukemia was caused by toxic substances radiating from the landfill, which was owned and operated by the City.

"We filed this lawsuit as a result of an usual high occurrence of illnesses and cancer among the residents living in close proximity to the Landfill," commented Korek.

The City of New York finally agreed to pay $12 million to settle the eight lawsuits involving twelve plaintiffs, which date back to the early 1990s.

"These two settlements are a testament to the determination and spirit of these families and individuals. While the money damages will never replace their losses, the time was ripe for closure," said Korek.
