Florida Law Preventing Custodial Parent Rights From Being Upheld Sees Challenge

Families for Custodial Justice seeks to eliminate the exemption that prevents custodial parents from holding non-custodial parents legally responsible for tortious interference with the custody of their child

Families for Custodial Justice, a new organization with the objective of changing current Florida law, announces its campaign to eliminate the exemption that prevents custodial parents from holding non-custodial parents legally responsible for tortious interference with the custody of their child. Spearheaded by Robert Glegg, the organization aims to educate the public as to why this change is critically needed and inspire a movement to support putting a new law in place.

On June 24, 2024, the Florida Supreme Court denied Glegg’s Petitioner’s Brief on Jurisdiction wherein Glegg was asking the Florida Supreme Court to hear his Appeal to change the law and eliminate the exemption. The implementation of this change will be a significant deterrent in reducing breaches of custody orders and will provide a methodology to obtain justice when the changed law is ignored, says Glegg. 

Families for Custodial Justice’s objectives include:

  • Raising Awareness: Highlight that there is no remedy in the Florida civil court system when one parent interferes with the custody of the other parent.
  • Inspiring and Enabling Change: Encourage discussions and action that leads to a change in the law, ensuring civil consequences for parental interference in Florida.

"We envision a future where the legal system prioritizes the welfare of children and protects custodial parents' rights," added Glegg. "Our goal is to create a legal landscape where justice is swift, fair, and focused on the best interests of the child, without exemptions or exceptions."

The organization is determined to change this narrative and protect the well-being of both children and their custodial parents.
