What are the different kinds of defective product liability claims?

To this the spokesman stated that, “while there are a wide range of injury-causing products in the market, there are three categories for defective product liability lawsuits.” These categories are:

  1. Defectively manufactured products – these products are manufactured incorrectly in some way because of a mistake made either at the factory or at some point between the factory and wherever the product was bought which resulted in the product being faulty; and thus, such a product falls under defectively manufactured products.  
     
  2. Defectively designed – this refers to products which are dangerous in some way but are manufactured correctly. Where such cases occur a whole product line, range or batch is affected by the defective design and are said to be unreasonably dangerous.
     
  3. Failure to provide or inadequate warnings and instructions – this is where the product does not come with the proper warning label or instructions as to how to use the product safely and appropriately. Or the product has instructions or warnings, but these are inadequate. This can be because of no physical labeling of products or marketing that is misleading. This category can also be called ‘defective marketing claims’.
